ONE YEAR LIMITED WARRANTY

Sabio’s warranty obligations are limited solely to the terms and conditions set forth below. Sabio reserves the right, at any time and at its sole discretion, to revise these warranty terms for new purchases of Sabio products and to establish the effective date of those revised warranty terms. Sabio Products are manufactured from parts and components which are new or equivalent to new in accordance with industry standards. This limited warranty specifically applies only to the Sabio Products that can be identified by the original, unaltered Sabio trademark, trade name or logo affixed to them. Sabio does not warrant any product which is not manufactured by, or, or with permission from Sabio.

Sabio warrants to the original consumer purchaser (“you” or “your”) that new Sabio storage products (“Products”) will be free from defects in material and workmanship for a period of one (1) year. The warranty period begins on the documented date of your purchase of the Product from Sabio or an authorized Sabio reseller. A sales receipt of other document showing when and where you purchased the product is considered proof of purchase.

If Sabio replaces any Product during the warranty period, the warranty on the replacement Product is the remainder of the original warranty period or ninety (90) days, whichever is longer.

If you detect a defect in material and/or workmanship at any other time during the warranty period, and Sabio agrees that the defect exists, Sabio will, at its option, repair or replace the Product at no charge to you, provided: (a) the Product is returned during the warranty period, shipping prepaid by you, to the location designated by Sabio; and (b) the Product is properly packaged in packaging approved by Sabio, with a return material authorization (“RMA”) number clearly displayed on the outside of the packaging. Under no circumstances does Sabio assume any responsibility whatsoever for any content or data on returned Products. Data should be backed up before sending a system to Sabio for repair, because product sent to Sabio or an authorized service provider may not be returned.

NOTWITHSTANDING THE RECOVERY CAPABILITY BUILT INTO THE PRODUCT, IT IS POSSIBLE THAT DATA COULD BE LOST IN THE UNLIKELY EVENT OF MULTIPLE HARD DRIVE FAILURE, POWER INTERRUPTIONS TO THE UNIT, SOFTWARE EVENT, HARDWARE FAILURE, ETC. THAT COULD CAUSE THE DATA IN THE ARRAY TO BE CORRUPTED. SABIO STRONGLY RECOMMENDS THAT AT ALL TIMES DURING YOUR OWNERSHIP OF ANY SABIO PRODUCT, YOU ARCHIVE OR BACK UP ALL CRITICAL DATA AND/OR PROGRAMS. SABIO EXPRESSLY DISCLAIMS ANY RESPONSIBILITY FOR SUCH DATA WHATSOEVER, AND SHALL HAVE NO LIABILITY ARISING OUT OF ANY DAMAGE TO, LOSS OR DISCLOSURE OF SUCH DATA.

This limited warranty does not cover any of the following conditions:

· Abuse, unreasonable use, mistreatment or neglect

· Unusual physical or electrical stress or power fluctuations

· Damage caused during installation of the Product

· Damage or capacity/performance/operational resetting caused by the equipment or system with which this Product is used

· Damage caused by modification or repair not made or authorized by Sabio

· Products whose Sabio serial number has been removed or defaced

· Damage caused by improper or improperly used packaging

· Damage caused by lack of ESD protection

· Products determined to have been stolen

· Labor charges for installation or setup of the Product

· Any taxes imposed on Sabio for units replaced or repaired under this warranty

· Damages to or viruses that may infect your Sabio Product

· Any product which has been modified or adopted to enable it to operate in any country other than the country for which it was designed, manufactured, approved and/or authorized, or repair of products damaged by these modifications

· Access connections (telephone or broadband) including charges from your communications provider.

Further, this limited warranty is void if the Product cover, or any label or seal on the Product, is removed or damaged. Sabio owns all parts removed from the repaired Products. Sabio uses new and reconditioned parts in performing repairs and building replacement Products.

THIS WARRANTY AND REMEDIES SET FORTH ABOVE ARE EXCLUSIVE AND IN LIEU OF ALL OTHERS, WHETHER ORAL OR WRITTEN, EXPRESS, IMPLIED OR STATUTORY. SABIO SPECIFICALLY DISCLAIMS TO THE EXTENT ALLOWED BY LAW ANY AND ALL IMPLIED WARRANTIES OR CONDITIONS AS TO THE PRODUCTS OR ANY OTHER MATTER WHATSOEVER, IN PARTICULAR, BUT WITHOUT LIMITATION, SABIO SPECIFICALLY DISCLAIMS ANY AND ALL IMPLIED WARRANTIES OR CONDITIONS OF SATISFACTORY QUALITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT OF THIRD PARTY RIGHTS OR ANY OTHER WARRANTY ARISING FROM A COURSE OF DEALING OR USAGE OF TRADE. THIS LIMITED WARRANTY DOES NOT APPLY TO, AND SABIO MAKES NO WARRANTY WITH REGARD TO PRODUCTS ORIGINALLY SOLD AS AN INTEGRATED COMPONENT OF A SYSTEM NOT SUPPLIED BY SABIO OR PRODUCTS PROVIDED UNDER A THIRD PARTY LEASING OR SERVICE AGREEMENT.

No Sabio distributor, reseller, dealer, agent or employee is authorized to make any modification, extension or addition to this Warranty.

SABIO IS NOT RESPONSIBLE OR LIABLE FOR ANY INDIRECT, UNFORESEEABLE, SPECIAL, INCIDENTIAL OR CONSEQUENTIAL DAMAGES HOWEVER CAUSED AND WHETHER OR NOT SABIO WAS ADVISED IN ADVANCE OF THE POSSIBILITY OF SUCH DAMAGES, INCLUDING, BUT NOT LIMITED TO, COSTS OF OBTAINING SUBSTITUTE GOODS, LOSS OF DATA OR PROGRAMS, LOST PROFIT, DOWNTIME, GOODWILL, DAMAGE OR REPLACEMENT OF EQUIPMENT AND PROPERTY AND ANY COSTS OF RECOVERING, PROGRAMMING OR REPRODUCING ANY PROGRAM OR DATA STORED IN OR USED WITH SABIO PRODUCTS OR ANY OTHER DAMAGES ARISING OUT OF THE PURCHASE, USE OR PERFORMANCE OF THE PRODUCT.

Sabio is not, and cannot be, responsible for any losses or damages arising out of any loss of, or any inability to access data as a result of the failure of a Product, and accordingly, you bear this risk. The allocation risk under this limitation of liability is reflected in the purchase price of the Product. This limitation of liability, however, will not apply to claims for death or personal injury caused by the negligence of Sabio or its associated companies, officers, representatives or agents.

Some states do not allow the exclusion or limitation of incidental or consequential damages or exclusions of implied warranties, so the above limitations or exclusions may not apply to you. This warranty gives you specific legal rights, and you may also have other rights that vary from state to state.

Please note that you are expressly not permitted to use the Sabio products in conjunction with the operation of nuclear facilities, aircraft navigation, aircraft communication, aircraft flight control, aircraft air traffic control systems, weapons devices or systems, or in any devices or systems in which a malfunction (including, without limitation, software related delay or failure) would result in foreseeable risk of injury or death to the operator of the device or system, or to others.
